According to Article 36 of the Employment Act 2013, employment services are as follows:
Employment services:
- Employment services include: counselling, job referrals; supply and recruit labor at the request of the employer; collect and provide information on the labor market.
- Employment service organizations include employment service centers and employment service businesses.
According to Article 40 of the Employment Act 2013, the operation of employment service businesses is as follows:
Activities of businesses providing employment services:
- Consulting and referring jobs to employees and employers.
- Supply and recruit labor at the request of the employer.
- Collect and provide labor market information.
- Analyse and provide forecast for the labor market.
- Skills training, vocational training in accordance with the law.
- Implementation of programs and projects on employment.
According to Article 14 of Decree 23/2021/ND-CP stipulating the conditions for granting operation licenses to employment service businesses:
Licensing conditions
- Possessing a location where the head office or branch is placed in order to provide employment services that is owned by the business or is leased in a stable manner by the business under a contract of 3 years (36 months) or more.
- The business has made a deposit of 300,000,000 VND (three hundred million VND).
- The legal representative of a business providing employment services must satisfy the following conditions:
a) Is a business director according to the provisions of the Business Act;
b) Not falling into one of the following cases: being examined for penal liability, being held in temporary detainment, serving a prison sentence, serving administrative punishment at a compulsory addiction centers or compulsory education institution, fleeing the place of residence, having limited or debilitated capacity, having impairment in cognition or behavior control, being banned by the Court from holding certain positions or practicing certain professions or managing employment services;
c) Having a university degree or higher or having directly worked as a professional or managed employment or labor services for full 02 years (24 months) or more within the previous 05 years when applying for a license.
